§ 1 Scope and provider

These General Terms and Conditions apply to all orders you place through the online shop at hallwerk.store.

Small business under § 19 UStG (German VAT Act) – no VAT is shown. Sole proprietorship, not entered in the commercial register.

Our offer is aimed exclusively at consumers within the meaning of § 13 BGB who are at least 18 years old.

§ 2 Conclusion of contract

The presentation of products in the online shop is not a legally binding offer, but an invitation to you to place an order.

By submitting your order you make a binding offer to buy the goods in your cart. Until you submit it, you can change your entries at any time using the usual keyboard and mouse functions and your browser's back button, or cancel the order.

After your order is received you will get an automatic acknowledgement of receipt by email. This acknowledgement is not yet an acceptance of your offer.

The purchase contract comes into effect as soon as we expressly declare acceptance or dispatch the goods to you. If we do not accept your offer, we will inform you without delay and refund any payments already made.

§ 3 Prices and shipping costs

All prices are final prices in euros. Because of the small business regulation under § 19 UStG, no VAT is shown.

Standard shipping within Germany is free – the price shown is the total price there. If you choose a faster shipping method or delivery abroad, the additional shipping costs are displayed during the ordering process before you submit your order.

§ 4 Payment

The payment methods offered during the ordering process are available to you. The purchase price is due upon conclusion of the contract.

§ 5 Delivery and delivery area

We deliver to Germany, to the other countries of the European Union and to the United Arab Emirates, Australia, Canada, Switzerland, Hong Kong, Israel, Japan, South Korea, Malaysia, Norway, New Zealand, Singapore and the USA.

For deliveries outside the European Union, customs duties and import charges may apply. These are payable by the recipient in addition to the purchase price and are not levied by us.

If an ordered item is unavailable or delivery is delayed, we will inform you without delay by email.

§ 6 Retention of title

The delivered goods remain our property until payment has been made in full.

§ 7 Right of withdrawal

As a consumer you have a statutory right of withdrawal. The conditions, the time limits and the model withdrawal form can be found in our withdrawal policy.

§ 8 Liability for defects

The statutory rules on liability for defects apply. If the delivered goods are defective, you may first request subsequent performance; your other statutory rights remain unaffected.

Please report obvious transport damage to us promptly. This does not restrict your statutory rights – it only helps us to pursue the claim against the shipping service provider.

§ 9 Liability

We are liable without limitation for damage arising from injury to life, body or health, for damage caused by intent or gross negligence, and under the German Product Liability Act.

In the case of slightly negligent breach of an obligation that is essential to the proper performance of the contract and on whose fulfilment you may regularly rely, our liability is limited to the foreseeable damage typical for this type of contract. Otherwise liability is excluded.

§ 10 Contract language and contract text

The contract is concluded in German or English – depending on the language in which you place your order.

We send you the content of your order with the order confirmation by email. You can view, print and save these terms and conditions on this page at any time.

§ 11 Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

§ 12 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.

If any provision of these terms and conditions is invalid, the validity of the remaining provisions is unaffected.
